UMO Rewards™ Loyalty Program Policy
UMO® is a registered trademark, and UMO Rewards™, and UMO APP™ are trademarks of Cubic Corporation in the United States.
This UMO Rewards™ Loyalty Program Policy (“Rewards Policy”) sets forth and explains the guidelines and practices of the UMO Rewards™ Loyalty Program (“UMO Rewards™”) on the UMO App™. UMO Rewards™ is a service provided by Cubic Transportation Systems, Inc., a division of Cubic Corporation (“Cubic”) and its subsidiaries. By joining UMO Rewards™, you are accepting the guidelines, practices, terms and conditions stated in this Rewards Policy.
Capitalized terms not otherwise defined below shall have the meanings set forth in the appendix “Terminology” to this Reward Policy.
Under UMO Rewards™, you have the opportunity as a transit rider of a participating Transit Agency or as an UMO App™ user, to engage with advertising content and offers and earn valuable loyalty points in the form of “Stars”. These Stars may be used to subsidize or pay for transit services or other product and service offerings.
Stars are a proprietary digital loyalty currency owned and operated by Cubic and are intended solely for use on transit systems. Stars have no value outside of the UMO Rewards™ program and cannot be redeemed for cash. Each Star may only be turned into a product or redeemed for service on a transit system with a participating Transit Agency.
2. Star Reward Prerequisites
2.1 Account Registration
You must have an existing account in the UMO App™. If you do not have an account, you must first set up an account with the UMO App™ for UMO Rewards™.
2.2 Join the UMO Rewards™ Program
Once you have registered for and established an UMO App™ account, you may join UMO Rewards™. This is independent of any other loyalty programs that you may have previously opted into through other Transit Agency apps.
2.3 Link Existing Loyalty Accounts
If you have one or more existing loyalty accounts with other Transit Agencies, you cannot link the existing accounts to a new Transit Agency account.
2.4 Your Profile
You may view your account profile on the UMO App™. The account profile includes contact information such as your name, e-mail address, street address, phone number, and demographic information. You may edit your profile and view your Star account balance and recent transactions. However, your e-mail address cannot be edited. You must create a new account if you want to change your email address.
2.5 Opt out of UMO Rewards™
You may opt out of UMO Rewards™ at any time. Once your opt out is complete, you will no longer be eligible for the Star rewards, and you will forfeit all accumulated Stars. Once Stars are forfeited, Stars cannot be reinstated, but you can earn new Stars by opting into UMO Rewards™ again.
3. Loyalty Reward Management
3.1 Star Reward Options
There are four ways you can earn Stars while using UMO App™depending on offer availability:
- Viewing video ads
- Responding to ads
- Receiving Stars awarded by a Transit Agency
- Accepting a third party’s card-linked offer
You will be credited with Stars to your UMO Rewards™ account if you take one of the above actions.
For viewing video ads and responding to ads, you must stay logged in to your UMO Rewards™ account and fulfill the reward criteria in order to be credited with Stars.
You will see ads whether or not you have joined UMO Rewards™ but you can gain valuable Stars if you do join.
For Stars awarded by a Transit Agency or purchases using a linked payment card with participating merchants as part of the available card-linked offers, it is not necessary to be logged into your Transit Agency account to receive credit with Stars.
Redemption of Stars requires that you be logged into your UMO Rewards™ account.
3.1.1 Video Ad View
Each time you complete a viewing of a video ad, you will be awarded Stars. You can watch a video more than one time but will only be awarded with Stars once for each qualified view of the same video ad within each session. If you complete a qualified view of more than one video ad, you will be awarded with Stars for the corresponding number of unique video ads that you watch. The number of Stars awarded varies depending on the length of the video. You will be able to see the number of Stars you will get for watching each video.
Each time a video ad plays continuously up to 30 seconds or for the full duration of the ad of less than 30 seconds, it will be counted as a view.
3.1.2 Ad Response
Each time you complete a response to an ad offer, you will be awarded with Stars. An Advertiser will specify a dollar amount to award in Stars for each ad response from you, such as answering a survey, joining a contest, signing up for newsletters, or purchasing an item.
The number of Stars awarded for each qualified engagement action varies depending on the type of ad response. You will be able to see the number of Stars you will get for each ad response.
3.1.3 Stars Awarded Directly by Transit Agency
Transit Agencies may award Stars to you for various activities and allow you to redeem Stars for transit tickets or other transit services offered by that particular Transit Agency. The number of Stars awarded for each activity varies at Transit Agency’s own discretion. You will be able to see the number of Stars you will get for taking each activity offered by Transit Agency.
3.1.4 Third Party Card-linked Offer Acceptance
Financial services providers may award Stars to you if you agree to link your card issued by a financial service provider with your UMO Rewards™ account. Additionally, you may also be awarded with Stars for using your card to pay for other qualified expenses defined by the financial services provider. The number of Stars awarded for each activity varies at the financial services provider’s own discretion. You will be able to see the number of Stars you will get for accepting the card-linked offer.
3.2 Star Reward Value
Each Star awarded to you has a value of US$0.005. However, the Stars have no cash surrender value.
3.3 Star Redemption Price
Star Redemption Price is the dollar value ratio that UMO Rewards™ uses to calculate the number of Stars required for a redemption option that a loyalty user selects. The Stars Redemption Price has a value at $0.005 per Star applied for all Stars redemption activities.
3.4 Star Transfer
Stars cannot be transferred from one UMO Rewards™ account to another UMO Rewards™ account.
3.5 Star Expiration
You must remain active in UMO Rewards™ to retain Stars you accumulate. If your UMO Rewards™ account is inactive for twelve (12) consecutive months, you will forfeit all accumulated Stars. Once Stars are forfeited, the Stars cannot be reinstated, but you can earn new Stars, unless your account has been deactivated.
An account is in inactive status when you do not participate in any loyalty point earning and redemption with your UMO Rewards™ account. Periods of impacted force majeure events that directly or indirectly prevent you from participating in UMO Rewards™ will not be counted toward the inactive account status duration. UMO Rewards™ will reasonably determine the length of the period impacted by such events. UMO Rewards™ and our authorized loyalty partners will make necessary adjustments to the UMO Rewards™ account status in such cases.
3.6 Star Reward and Redemption Process
3.6.1. Awarding of Star Reward
After you complete a qualified activity, you will be awarded with a set number of Stars in your Star account. Your Star account balance will be updated accordingly.
3.6.2. Star Redemption Procedure
Stars may be redeemed for products or services such as a mobile pass, which will be credited to your Transit Agency Account. The availability of transit card types varies by Transit Agency. You may redeem Stars upon logging into your transit account on UMO App™. You may NOT purchase or redeem Stars for cash.
You may see your past Star transaction history, including Star transaction type, Star transaction date, Star transaction amount, Star transaction balance, transit redemption value, and transit redemption currency.
3.7 Termination of UMO Rewards™ in a Specific Region
If UMO Rewards™ is terminated in a specific region, UMO Rewards™ will notify you of the loyalty program termination in your region by digital or written communications means. You will then have 30 days since receipt of the termination notification to redeem Stars for transit value from the transit agencies within that region.
Your loyalty account shall remain active unless indicated otherwise. You may still earn Stars and redeem Stars with other participating transit agencies from other regions by switching your original region to other desired region in your account setting.
4. Star Loyalty Reward Program Policy DisclaimersNo Warranty
The UMO Rewards™ are made available on an “as is, where is” basis. Cubic and its subsidiaries make no warranty or representation, whether express or implied in fact or in law, of merchantability, fitness for purpose, functionality or availability. Cubic and its subsidiaries make no warranties or representations, either expressed or implied, with respect to type, quality or fitness of goods or services provided through UMO Rewards™.
Cubic and its subsidiaries do not give, and expressly disclaim, any warranty (express or implied) as to the fitness for purpose, accuracy, compliance with law, policies, regulations, or any other judicial or administrative orders of the loyalty and advertising content. Advertisers and Sponsors are solely responsible for the nature and messaging of any advertising content made available to you as a result of your participation in UMO Rewards™.
The UMO Rewards™ program and its benefits are offered at the discretion of Cubic and its loyalty partners and are subject to change at any time.
Right to Modify or Terminate
Cubic, its subsidiaries, and its loyalty partners reserve the right to terminate the UMO Rewards™ at any time and to or modify the UMO Rewards™ policy, reward criteria, and benefits without notice to you even though such changes may affect your reward value and benefits accumulated.
Cubic and its subsidiaries reserve the right to ask loyalty partners or Sponsors, without notice to you, to withdraw Star points, redeemed items or update your UMO Rewards™ balance if you are seen to have acted against UMO Rewards™ policy or if Stars are erroneously credited to your account.
Interpretation of UMO Rewards™ Policy
All interpretations of this UMO Rewards™ Policy regarding eligibility are at Cubic’s sole discretion, and Cubic’s decisions will be final. In the event of any discrepancy between the English version and any translated version of these UMO Rewards™ Policy, the English language version will govern.
Cubic, its subsidiaries and participating Transit Agencies, Advertisers and Sponsors are the sole and exclusive owners or licensees of their respective trademarks, service marks, trade names, logos, and copyrighted or copyrightable materials.
Cubic’s waiver of any breach of this UMO Rewards™ Policy by you will not constitute a waiver of any other prior or subsequent breach of this UMO Rewards™ Policy. Cubic’s failure to insist upon strict compliance with this UMO Rewards™ Policy by you will not be deemed a waiver of any rights or remedies Cubic may have against you. Cubic may waive compliance with this UMO Rewards™ Policy in its sole discretion.
Limitation of Liability
IN NO EVENT WILL CUBIC, ITS SUBSIDIARIES AND AFFILIATES, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH THE UMO REWARDS™ PROGRAM, THIS UMO REWARDS™ POLICY, OR CUBIC’S OPERATION OF THE UMO REWARDS™ PROGRAM.
Choice of Law and Venue
Any disputes arising out of or related to UMO Rewards™ or this UMO Rewards™ Policy will be handled individually without any class action, and will be governed by, construed and enforced in accordance with the laws of the State of California, United States, without regard to its conflicts of law rules. The exclusive jurisdiction for any claim or action arising out of or relating to UMO Rewards™ Program or this UMO Rewards™ Policy may be filed only in the state or federal courts located in the County of San Diego, State of California, United States.
Subject to Law
Participation in UMO Rewards™ and the earning and redeeming of Stars are subject to all applicable local laws and regulations. Participation in UMO Rewards™ and Redemption Stars are offered in good faith; however, they may not be available if prohibited or restricted by applicable law or regulation in the United States or your jurisdiction of residence. If any part of this UMO Rewards™ Policy is held to be unlawful or unenforceable, that part will be deemed deleted from this UMO Rewards™ Policy in such jurisdiction and the remaining provisions will remain in force.
The UMO Rewards™ Policy, together with any other terms and conditions, rules, or regulations incorporated herein or referred to herein constitute the entire agreement between Cubic and you relating to the subject matter hereof, and supersede any prior understandings or agreements (whether oral or written) regarding the subject matter, and may not be amended or modified except in writing or by making such amendments or modifications available on the UMO App™.
Advertiser / Advertisers: Advertisers produce ads and place ads via UMO App™ and Cubic’s loyalty and advertising partners to be displayed to you. Advertisers may sell goods or services to you in physical storefronts.
You / you: Individual persons who use transit services provided by Transit Agencies and who shop at Retailers. You view and interact with ads placed UMO App™ and/or devices. You earn Stars for viewing and interacting with ads, or for events governed by the Transit Agency, and may redeem these Stars on UMO App™.
Sponsor / Sponsors: An advertiser, a Transit Agency, or a third party who pays for advertising or loyalty content to be served on Cubic’s or Transit agencies’ device(s).
Star Redemption/Redeeming Stars: You exchange Stars for dollar value using your Star account inside Transit Agency’s apps and/or mobile devices.
Star Rewards: Stars awarded to you for your qualified loyalty-based ad engagement activities or as per Transit Agency’s own discretion
Transit Agency / Transit Agencies: Organizations that operate transit services. Transit Agencies provide mobile apps and devices whereby via UMO App™and its loyalty and advertising partners can serve display ads. Transit Agencies award Stars to you for various activities and allow you to redeem Stars for transit services or other products offered by the Transit Agency. Transit Agencies provide Tier One customer support to you for your UMO Rewards™ account.
